1. Purchase Terms
These Purchase Terms will govern any goods (“Goods”) you purchase from Pullmoon® (“Pullmoon”, “we”, “us”) through the Pullmoon® website www.pullmoon.com (“Website”). Before ordering any Goods through the Website (“Order”), you should read and ensure that you understand these Purchase Terms. You may not order Goods through the Website if you do not agree to these Purchase Terms.
2. Terms and Conditions of Use and Privacy Policy
In addition to these Purchase Terms, the Terms and Conditions of Use (“Terms and Conditions”) and Privacy Policy also govern your access to and use of the Website. You should ensure that you have read the Terms and Conditions, the Privacy Policy, and these Purchase Terms. By accessing the Website, you are deemed to have read and agreed to be bound by the Privacy Policy and the Purchase Terms.
3. Amendments
Pullmoon® reserves the right to amend these Purchase Terms from time to time. Amendments will take effect immediately upon posting on the Website. Your continued use of the Website after such amendments are made will constitute your agreement to be bound by the revised Purchase Terms. Such modifications may include replacing these purchase terms with entirely new purchase terms.
4. Orders
You can order the items described on the website at the prices specified on the website. All prices are in New Zealand dollars and include Goods and Services Tax (“GST”) levied under the Goods and Services Tax Act 1985 (“GST”). Pullmoon® reserves the right to change prices at any time without notice.
5. Details
Your order must include your name, email address, credit card details, billing address, delivery address, and any other ordering information specified on the website.
6. Cancellation
You cannot cancel an order after it has been submitted. Pullmoon® may refuse your order at any time without requiring a reason for refusal.
7. Refusal
If we refuse your order for any reason, neither you nor we will have any further obligations to the other party arising from your order or our refusal of that order.
8. Reimbursement
If we refuse your order, we promise to reimburse you for any payments we have received.
9. Delivery
Unless otherwise agreed with you, goods will be delivered to you in a manner chosen by Pullmoon®. Pullmoon® is not liable for any delayed delivery or non-delivery of ordered goods, except as provided under the Consumer Protection Act 1993.
10. Ownership
Ownership of the goods will not transfer to you until Pullmoon® or its agents have received full payment. You acknowledge that these terms of purchase create a security interest in any goods purchased from this website as defined in the Personal Property Securities Act 1999 (NZ), and Pullmoon® may register a financing statement at any time on the Personal Property Securities Registration website to protect its security interest in the goods. While Pullmoon® retains ownership of the goods, you must properly store the goods and ensure that they are identifiable as Pullmoon® products.
11. Payment
Payment must be made in accordance with the methods described on the website. Unless otherwise stated, prices include Goods and Services Tax (GST). However, prices do not include other taxes, duties, and charges relating to the availability of goods in New Zealand or overseas. If payment is made by credit card, you will be responsible for all orders placed using that credit card.
12. Eligibility
These goods are sold only to persons capable of entering into legally binding contracts. You are responsible for identifying and complying with all applicable laws relating to the use of the website and the purchase of goods from the website (including minimum age requirements for legally binding contracts).
By placing an order for the goods, you represent that you are capable of entering into legally binding contracts and that the purchased goods will be used legally.
13. Consolidation Terms
These terms of purchase, along with any other terms and conditions contained in the invoice or any other similar document issued by Pullmoon®, will govern your purchase of the goods.
14. Ownership and Risk
Ownership and risk of the goods transfer to you upon delivery to your agent or carrier, or upon delivery to the address you provided at the time of placing the order.
15. Incorrect Orders
Missing or incorrect orders must be reported to Pullmoon® within seven (7) business days of receipt of the order, along with the invoice number. All returned goods must be clean and free of price tags. Damaged or unresaleable goods may not be fully credited to the credit side.
16. Returns of Incorrect or Excess Orders
For goods that exceed your requirements or are incorrectly ordered, Pullmoon® reserves the right to charge a handling fee of up to 20% of the original invoice value for the return of such goods. Pullmoon® requires authorization before returning any goods, and Pullmoon® is under no obligation to grant any such authorization.
17. Defective Goods
We will fulfill all obligations under the Consumer Warranty Act. Goods returned more than 7 days after delivery and/or goods that are unresaleable due to non-refundable new stock. We cannot accept exchange items returned after 7 days. Please note that we are under no obligation to refund unless the item is defective or damaged.
18. Disclaimer
Under no circumstances shall Pullmoon®, its employees, or agents be liable to you for any loss, damage, cost, legal fees, professional or other expenses of any kind arising out of or relating to any dispute or contractual, tortious, legal, regulatory or other cause or effect of any claim or action against you or any other third party (including, without limitation, any economic loss or other loss of turnover, profits, business or goodwill) related to the goods supplied with your order under the website, or related to Pullmoon®’s failure or omission of any obligation set forth in these Terms of Purchase. By using the website or purchasing goods for commercial purposes, you agree that the Consumer Warranty Act of 1993 does not apply.
19. Scope of Liability
If any limitation or provision contained in these Terms of Purchase is deemed invalid or unenforceable for any reason, and Pullmoon® is liable for any loss or damage that would have been excluded, Pullmoon®'s maximum liability under this contract shall be based on the lesser of the value of the goods contained in the order, the cost of repairing or replacing the defective goods, and any actual loss or damage suffered by you, directly or indirectly arising from the goods supplied under the order; the cost of repairing or replacing the defective goods; and any actual loss or damage suffered by you. All other warranties, representations, and conditions concerning fitness for any purpose or particular condition, even if expressly indicated or implied (whether express or implied), whether or not they are for sale or otherwise, are expressly excluded unless the law provides for no exclusion of such liability.
20. Fitness for Use
You acknowledge that you have investigated the fitness for your own purpose with respect to the goods.
21. Notification of Issues
Pullmoon® shall not be liable for any damage, discrepancy, or shortage of the goods unless you notify Pullmoon® and the carrier within 48 hours of the date of delivery.
22. Severability
If any provision of these Terms of Purchase is deemed invalid, void, unenforceable, or illegal for any reason, such provision shall be deemed severable from these Terms of Purchase, and the remaining provisions shall remain in full force and effect.
23. Product Description and Inventory
All product descriptions, specifications, quantities, and prices described on the website are subject to change without notice. Certain weights, measurements, and similar descriptions are approximate and for informational purposes only.
Pullmoon® will make every reasonable effort to accurately display the attributes of the products, including applicable colors; however, the actual colors you see will depend on your computer, and we cannot guarantee that your computer will display these colors accurately.
Pullmoon® will make every effort to ensure your order is fulfilled; however, Pullmoon® makes no guarantee regarding the availability of goods ordered on the website.
24. Pricing Errors
Pullmoon® will use every reasonable effort and exercise every reasonable care to ensure that the prices of products available for purchase on the website are accurate. However, sometimes certain products may be incorrectly priced. If a pricing error is discovered and you have already placed an order, Pullmoon® reserves the right to cancel the order at its discretion and, if payment has been made, to issue a full refund. We will contact you to inform you of the correct price and seek guidance on whether you wish to place a new order at the correct price. Pullmoon® has no obligation to supply products at incorrect prices.
25. Waiver
It does not constitute a waiver of any rights or remedies if we delay or fail to exercise any of our rights or remedies under these Terms of Purchase.
26. Retention of Copies
You should print and retain or otherwise store a copy of these Terms of Purchase for future reference.

16.错误或超额订单的退货
